When you contact the Company to book your tour, you appoint them to act as your agent to obtain the requested services for you. When they have done so, and you have confirmed the booking and paid the deposit, they will accept responsibility for providing your vacation from that point onwards. No employee or representative of the Company has the authority to change these conditions or information. This Agreement shall be governed by the substantive laws of the State of Kansas. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within Johnson County, State of Kansas, United States of America. Deposit & Final Payment: In order to confirm a booking a non-refundable deposit of 25% of the agreed land cost per person, subject to a minimum $1,500 deposit, is required. It may be paid by check, or credit card – American Express, MasterCard, VISA or Discover may be used. Bookings are only accepted subject to the availability of required tour services such as accommodations and golf starting times. Payment of balances and cancellation penalty schedules for Customized Programs (unless otherwise specified in your tour itinerary is as outlined below. CUSTOMIZED PROGRAMS *Days prior to commencement of Carriage Trade Golf, LLC arrangements at destination Cancellation Penalty Schedule 90 days or more prior* Loss of Deposit Payment Schedule 99-60 50% Refund On booking 25% (min deposit $1500) 59-30 25% Refund 90 days prior* Full balance 29 days or less No Refund Travel Insurance: Carriage Trade Golf, LLC recommends that you have luggage, accident and trip cancellation insurance. Carriage Trade Golf, LLC is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness. It is important for your own self-interest and protection that you make certain you have adequate coverage. Check with your insurance company or on the internet under Travel Insurance. Several very good companies offer reasonably priced travel insurance. Car Rental: On independent tours with a rental car, all drivers must be over 25 years of age, and under 65. Note: We strongly recommend chaffered and guided tours for our clients. Air Travel: Airline tickets for travel on scheduled airlines, if they are purchased for you by Carriage Trade Golf, LLC, are a separate item out with the travel package, and may carry change and cancellation penalties as specified by the carrier. Documentation: For US citizens, a current passport is required for overseas travel. Please check for visa requirements in the “Special Destination Notes” section. Citizens of other countries should check with the appropriate Embassy. Changes: An administrative fee of $50.00 per change per person will be charged for changes requested by client or travel agent after deposit has been received and confirmation issued. In most cases, changes cannot be made less than 60 days before travel. Name Changes : In the event you wish to change the name of one of the golfers previously confirmed on a trip, the following per person charges shall apply; more than 60 days before departure – a charge of $100 plus any applicable nonrefundable deposits paid to golf clubs which prohibit transfer of deposits, 60 – 21 days before departure a charge of $400 plus any applicable nonrefundable payments made to golf clubs which prohibit transfer of same; less than 21 days before departure a charge of $800 plus any applicable nonrefundable payments made to golf clubs which prohibit transfer of same. Cancellations: Notification of cancellation by a client must be forwarded in writing to Carriage Trade Golf, LLC. Cancellation charges vary depending on the travel package purchased. The schedule of cancellation charges for various packages is listed at the base of these conditions. No refund will be made for unused portions of a travel package. Golf Handicaps: A number of golf clubs require visitors to show handicap cards. While this is not particularly common we strongly recommend you travel with a handicap card, and accept no responsibility if you do not and are subsequently denied golf. Certain clubs also place maximum handicap restrictions on visitors. If your handicap is greater than 24 (men) or 36 (ladies) please notify us in order we can discuss which clubs may have relevant restrictions. Also, please note that Carriage Trade Golf, LLC can accept no responsibility for the playing conditions of any golf courses, including changes caused by course maintenance or weather conditions. Responsibility: Carriage Trade Golf, LLC, as the tour operator, and its selling agents act only as agents in securing and booking the hotel accommodations and other land tour services provided as others as independent contractors. Carriage Trade Golf, LLC, its selling agents or the specified air carriers assume and accept no liability for injury, loss, damage, accident. delay, changes or inconvenience caused by: any force majeure - health risks - reason of war or threat of war – riots - civil strife - terrorist activity - industrial disputes – acts, omission, neglect, delay or default of any person engaged in providing any tour services including transportation and accommodation - technical problems to transport - closure or congestion of airports or ports - building work - extended hotel closure - cancellations or changes of schedules by airlines - interruption or failure of public utilities outside the control of the hotel and similar events beyond our control, including storms, tempests and hurricanes. If any tour service or its reasonable equivalent is not provided due to events beyond the reasonable control of Carriage Trade Golf, LLC, the company will make an appropriate refund of that portion of the tour price covering the undelivered tour service, but it is understood that Carriage Trade Golf, LLC shall have no other or further responsibility or liability either for the accuracy of any representation or the non provision of any tour services. Transport by aircraft, rail, ship or coach will depend on the conditions of carriage of the relevant carrier. These conditions of carriage may limit or exclude the carrier’s liability to you under international law (such as the Warsaw Convention). The responsibility and liability of the specified air carriers respecting their performance of air transportation services are limited by and subject to the conditions of contract in the passenger ticket, the rules contained in tariffs on file with U.S. Department of Transportation (available for inspection on request), and applicable provisions of law and treaty. Carriage Trade Golf, LLC is not liable for loss, damage or theft of luggage or personal belongings, for personal injury, accident or illness on any vehicle or at any place throughout the tour. Carriage Trade Golf, LLC reserves the right to cancel a tour if circumstances so require. In the event of such, Carriage Trade Golf, LLC will make a full refund to travelers of all payments received in respect of the tour. Such a refund of payments will be the full extent of Carriage Trade Golf, LLC’s obligation and liability to travelers. This Agreement shall be governed by the substantive laws of the State of Kansas. The parties irrevocably agree that any judicial proceedings relating to this agreement will be filed in a court of competent jurisdiction within Johnson County, Kansas. Brochure Accuracy: As far as is known all information in the promotional and other materials of the Company is accurate at the time of publication. Changes cannot be made after publication date, and the Company accepts no responsibility for any omissions or errors. Should the Company become aware of errors which could materially affect your travel package, they will take all reasonable steps to inform you in a timely manner. Caddies: As a free service to clients, Carriage Trade Golf, LLC will request caddies for those who wish them, however they cannot be guaranteed. They may only be requested for the entire duration of a trip, and not for individual rounds. If you request caddies, Carriage Trade Golf, LLC will forward a request for caddies in advance of your visit. The golf clubs will make every effort to secure caddies but they are neither employed by the golf clubs nor by Carriage Trade Golf, LLC. Please consult with your Golf Travel Specialist at Carriage Trade Golf, LLC regarding the likelihood of accessing a caddie on your selected courses. In general the demand for caddies at most courses exceeds the availability. If a caddie is secured for you, the caddie master or another club official will inform you of the caddie charge and tipping policy. Special Destination Notes; Australia : Entry Requirements - Australia requires US citizens to obtain a visa which is issued by the airline transporting you to Australia. No caddies in Australia. Motorized golf carts are available on most courses. On some courses they are limited in numbers. Italy: No caddies in Italy. Carts and pullers (for trolleys) available (not experienced caddies). New Zealand: Entry Requirements - A valid passport that does not expire for a minimum of 3 months after date of departure from New Zealand No caddies in New Zealand. Motorized golf carts are available on most courses. On some courses they are limited in numbers. South Africa: Entry requirements – South Africa does not require visa for US Citizens, if extending trip to neighboring countries please check their entry requirements. Your passport must have minimum of two empty pages for entry into South Africa. If you are scheduled for a safari experience on your Carriage Trade Golf, LLC you must sign and return the South African addendum. Please consult your doctor if you are planning to travel to a malaria risk area and evidence of inoculation shall be required (valid for 10 days) if you have traveled through an area of Africa or South America with Yellow Fever.
